GENERAL TERMS AND CONDITIONS (AGB)

1. Scope of Application
1.1. These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all business relations between Nishuthan Raveenthiran (hereinafter “Photographer/Contractor”) and the customer (hereinafter “Client”).
1.2. Deviating, conflicting, or supplementary terms and conditions of the Client shall not become part of the contract unless explicitly agreed to in writing.
2. Conclusion of Contract & Booking
2.1. Offers made by the Photographer are subject to change and non-binding.
2.2. A binding contract is formed upon the written acceptance of an offer (via Email or signed quote) or by the Client’s concrete booking confirmation.
2.3. Scouting/Casting: Applications submitted via the scouting form on scouting.m1o.at do not constitute a representation contract. They serve solely for inclusion in the internal talent pool.
3. Copyright & Usage Rights
This is the most important section for your business.
3.1. The Photographer retains the sole copyright to all images, concepts, and videos produced, in accordance with the Austrian Copyright Act (Urheberrechtsgesetz).
3.2. The Client acquires a license for use (Werknutzungsbewilligung) for the agreed purpose, duration, and territory.
3.3. No Transfer of Ownership: The ownership of the raw files and the copyright remains with the Photographer. The Client pays for the use of the images, not the ownership.
3.4. Social Media: The Client may use the images on social media if agreed, provided that the Photographer is credited (e.g., “Photo: Nishuthan Raveenthiran” or “@moksha1one”).
3.5. Buyouts: Any use beyond the agreed scope (e.g., billboards, global campaigns, third-party licensing) requires a separate “Buyout” agreement and additional compensation.
4. Remuneration & Cancellation (Ausfallshonorar)
4.1. If the Client cancels a confirmed booking, the following cancellation fees apply:
- Cancellation up to 7 days before the shoot: 50% of the agreed fee.
- Cancellation within 48 hours or less: 100% of the agreed fee.
4.2. Invoices are payable within 14 days net, unless otherwise stated. 4.3. The Photographer is entitled to demand a deposit (down payment) of up to 50% before production starts.
5. Artistic Freedom & Editing
5.1. The Client is aware of the Photographer’s artistic style (as seen on raveenthiran.com and m1o.at). Complaints regarding the artistic style or editorial choices are excluded.
5.2. Raw Files: The Photographer delivers only curated, edited JPEG/TIFF files. The delivery of RAW files is excluded unless explicitly agreed upon and paid for separately.
6. Liability
6.1. The Photographer is liable for damages only in cases of intent or gross negligence.
6.2. The Photographer is not liable for technical failures, weather conditions, or the non-appearance of models booked by the Client.
7. Data Privacy
The handling of personal data is regulated in the Privacy Policy (available at https://raveenthiran.com/privacy).
8. Jurisdiction & Final Provisions
8.1. Austrian law applies exclusively.
8.2. The place of jurisdiction for all disputes constitutes Vienna, Austria.
